Amjad Ali Sahito, J-  Through this bail application, applicant Ghulam Rasool alias Punhal son of Muhammad Laique Chacher seeks his admission to post-arrest bail in Crime No.45/2021 of P.S B-Section Kandhkot, registered for offences punishable under Sections 23(1)(a) of the Sindh Arms Act, 2013. The bail application moved by the applicant before the learned Additional Sessions Judge-I, Kandhkot, was declined by means of Order dated 14.11.2022 passed in Crl. Bail Appln. No.208/2022.

 

            Learned counsel for applicant mainly contended that, per case of prosecution the applicant was required to police in a murder case and after encounter with police he was arrested along with kalashnikov and bullets for which he failed to produce any valid permission/ license. Per learned counsel the applicant has been acquitted from the charge in the case of police encounter vide Crime No.44/2021 of P.S B-Section Kandhkot and instant case is its off-shoot, and it is yet to be determined by the learned trial Court whether the weapon has been foisted upon applicant or otherwise. Learned counsel has place don record copy of judgment dated 04.1.2022 passed by learned 1st Additional Sessions Judge, Kandhkot, in Crime No.44/2021 of P.S B-Section Kandhkot.

 

            Learned D.P.G. appearing for State opposed grant of bail.

 

            In view of submission made by learned counsel for applicant a case for grant of bail in favor of applicant is made out. Accordingly, the instant bail application stands allowed. The applicant is admitted to post arrest bail upon his furnishing a solvent surety in the sum of Rs.30,000/- (Thirty thousand rupees) and P.R bond in the like amount to the satisfaction of learned trial Court.
