It is contended by learned counsel for the appellant that the offence for which the appellant has been convicted is bailable and aggregate sentence awarded to the appellant is 02 years with diyat and he has already completed his imprisonment yet his appeal is not proceeding for one or other reason. By contending so, she sought for release of the appellant on bail by suspending the operation of impugned sentence, which is not opposed by learned DPG for the State.

In view of above, while relying upon case of Makhdoom Javed Hashmi vs. The State (2007 SCMR 1844), the operation of the sentence awarded to the appellant is suspended, consequently, he is directed to be released on bail subject to his furnishing surety in the sum of Rs.100,000/- (Rupees One Lac) and P.R bond in the like amount to the satisfaction of Nazir of this Court.

The listed application (M.A.No. 2553/2022) is disposed of accordingly.

Adjourned to a date in office for haring of main appeal.
