1.                     Urgency granted.

2 & 3.              The applicant after dismissal of his transfer application by learned District Judge, Shikarpur, by way of instant application has sought for transfer of his rent execution application from the Court of learned 2^nd Rent Controller at Shikarpur to some other Court.

                        It is contended by learned counsel for the applicant that the behavior of learned Rent Controller is not good with the applicant; therefore, the applicant is not expecting fair trial. By contending so, he sought for transfer of execution application to some other Court.

                        Heard arguments and perused the record.

                        The execution applications normally are to be disposed of in terms of final order. As per order of learned District Judge, Shikarpur, the applicant is found reluctant to proceed with the execution application. If it is so, then the applicant could not be permitted to defeat the legal disposal of execution application at the cost of precious time of the Court by leveling a false allegation of misbehavior against its Presiding Officer. Consequently, the instant transfer application being misconceived is dismissed in limine.    

      JUDGE
