Learned counsel for the appellant present alongwith appellant has filed a statement alongwith copy of Razi-nama duly signed by the appellant and respondent as well as two witnesses and attested on 11.12.2021, according to which, the matter has been settled between the parties outside the Court. Attorney of the respondent present in Court verifies such position. Statement is taken on record.

Learned counsel for the appellant submits that in view of settlement between the parties appellant is not required to make any further payment, hence requests that security furnished before the Nazir of this Court pursuant to Court’s order dated 29.08.2018 may be directed to be returned to the applicant/surety after proper verification.

By consent, instant appeal stands disposed of alongwith listed application. However, subject to all just exceptions, Nazir is directed to release the security to the applicant/surety after proper verification, identification and as per rules.
