Through the instant constitution petition
petitioner Mumtaz Ali Sharhas called in question order dated 13.06.2018 passed
by learned District Returning Officer, whereby prayer of change of polling
station GBLS Muhammad Khan Siyal was not found justified and application for
change was rejected.
2. Notices
were issued against the respondents as well as DAG.
3. We
have carefully heard learned counsel for the parties and perused the relevant
record. It appears that learned D.R.O vide her order dated 13.06.2018 over
ruled objection of applicant Mumtaz Ali Shar on the transfer /change of polling
station GES BehramChakrani to GBLS Muhammad Khan Siyal. Relevant portion of the
order is reproduced as under:-
“Heard objector, his advocate/objector
and perused the relevant record. The proposed polling station GBLS Muhammad
Khan Siyal is situated at the considerable distance from population, having no
facilities and out of reach of voters as such it would be inconvenient for the
voters to caste vote. The proposal of polling station GBLS Muhammad Khan Siyal
is not justified, hence polling station in GES BehramChakrani having all
facilities, including, water, complete compound wall, light, already
established shall remain intact for the forthcoming General Elections-2018.”
4. Order
of D.R.O is well reasoned, justification has been given in the order. It is
stated that polling station in GES BehramChakrani having all facilities
including water, complete compound wall, light. Moreover the representative of
Election Commission of Pakistan submits that list of polling stations has
already been finalized and published in official gazette and it is available on
website of Election Commission of Pakistan.
Petitioner has also failed to avail remedy as provided under sub-section
8 of Sectiokn 59 of Election Act, 2017. No case of interference in the orders
of D.R.O is made out. Petition is without merit, the same is dismissed.
