Through this Petition, the
petitioner has sought the following relief(s):
a)
To declare the act of the respondents not to release the salaries of
petitioner and further direct them to reinstate into his earlier service and
regularize/confirm him for the said post of Gang-man as per rules & policy.
b)
To grant and other relief, which has not been specifically prayed
for, under the circumstances of the present matter.
c)
To award cost of the petition.
Comments have been filed wherein it
is stated that the petitioner was engaged as a temporary Gangman on 29-12-2012,
and thereafter, he worked up to 12-09-2015 on temporary basis and then remained
absent unauthorizedly. Thereafter, in some fresh application, he was again
called for interview, but could not be selected as he was placed at serial
No.69 in the merit list, whereas, the recruitment was made only for seventeen
(17) posts.
After going through the comments and
the contents of the Petition, we are of the view that no case for indulgence is
made out on behalf of the petitioner, as apparently, he remained absent as well
as he was a temporary employee, hence, no
question for regularization or reinstatement arises. Moreover, the
appropriate remedy even otherwise was before NIRC and not before this Court.
Accordingly, this Petition being misconceived is hereby dismissed.
