                             O R D E R

NAZAR AKBAR, J-  Through this application, the applicant  Jaffar Hussain seeks post arrest bail in a  case registered against him under Crime No.33/2020 Police Station, Sorah.

 

2.       Since the facts of the prosecution case have already been mentioned in the impugned order as well as in this bail application, therefore there is no need to repeat the same.

 

3.       Learned counsel for the applicant contended that the applicant is innocent and has been falsely implicated by the complainant with malafide intention and ulterior motive.He further contended that as per contents of F.I.R the allegation against the applicant is that he caused hatchet injuries whereas medical report shows that injuries caused by hard and blunt substance. He further contended that on identical circumstances, co-accused Ranjhan and others have already been granted bail by the learned trial Court vide order dated 11.11.2020, therefore, the present applicant is also entitled for same concession.

 

4.       Learned DPG appearing on behalf of the State has no objection for grant of bail on the ground that on similar circumstances, co-accused Ranjhan and others have already been granted bail.

 

5.       Since the co-accused Ranjhan and others have already been granted bail on identical circumstances and learned DPG has extended no objection, therefore I allow this application. The applicant Jaffar Hussain may be released on bail subject to his furnishing surety in the sum of Rs.100,000/- and P.R Bond in the like amount to the satisfaction of learned trail Court.

 

6.       The observations made hereinabove are tentative in nature and will not influence the trial Court while deciding the case on merits.
