          Through this criminal miscellaneous application, applicant Muhammad Yousif has challenged the order dated 12.12.2020 passed by the Court of learned III-Additional Sessions Judge/Ex-Officio Justice of Peace, Naushahro Feroze in Crl.Misc.Application No.3985/2020 whereby allowing the application filed by the respondent No.3 Abdul Hafeez for registration of F.I.R.

          Learned counsel for the applicant has not been able to satisfy that how the order allowing the application filed by the respondent for registration of F.I.R, can be suspended when the Ex-Officio Justice of Peace has made following observations in the impugned order:-

“As per narration of applicant after incident as alleged in this application, applicant went to Police Station concerned for registration of F.I.R against proposed accused named above, but same was declined. However, right of approaching to Police Station for re-redressal of grievance is fundamental right of every citizen of Pakistan, therefore, applicant is directed to appear before SHO P.S concerned who shall record statement of applicant under S.154 Cr.P.C and deal the matter purely in accordance with law. The application of applicant in hand is allowed”.

 

          After hearing the arguments of learned counsel for the applicant, and perusal of the impugned order, I am of the considered view that the learned trial Court has rightly passed the order dated 12.12.2020, which does not call for any interference. Criminal miscellaneous application is dismissed alongwith pending applications, if any.
