It is stated by learned counsel for the petitioner that detenue Shoukat Ali is detained illegally by the private respondents at Larkana; therefore,    his custody to be procured through official respondents and he then to be set free after recording his statement.

No cogent reason is advanced by the petitioner for having approached this Court directly without exhausting the remedy, which was available to him u/s. 491 Cr.PC before learned Sessions Judge at Larkana.

 In view of above, the instant constitutional petition is converted into an application u/s. 491 Cr.PC with direction to office to transmit the same to learned Sessions Judge at Larkana, for its disposal in accordance with law.
