            Heard arguments.

 

            The appellants were convicted and sentenced to undergo R.I for five years with fine of Rs.50,000/- each and in default whereof to undergo S.I for three months and also to pay compensation of Rs.100,000/- each to the complainant by learned 3rd Additional Sessions Judge, Shikarpur, vide judgment dated 07.01.2022, which is impugned by the appellants before this Court by preferring the instant criminal appeal, which is admitted to regular hearing and in the meanwhile, the appellants have sought for suspension of sentence and their release on bail, mainly for the reasons that the sentence is short one; hearing of appeal is likely to take time and they were enjoying the concession of bail at trial, which is not opposed by learned Addl.P.G for the State. However, it is opposed by the complainant in person by contending that though they are in jail; they are still threatening her of dire consequences.

            In view of above, while relying upon case of Abdul Hameed Vs. Muhammad Abdullah and others (1999 SCMR 2589), the sentence awarded to the appellants being short one, is suspended, consequently, they are admitted to bail subject to their furnishing surety in sum of Rs.50,000/- each and P.R bond in the like amount to the satisfaction of Additional Registrar of this Court.

            The listed application M.A.No.200/2022 is disposed of accordingly. The appeal is adjourned to 05.05.2022.
