            The petitioners by way of instant constitutional petition have sought for direction against the respondents to appoint them as Primary School Teachers, as they have qualified the requisite test. As per the comments filed by respondent No.4, the marks obtained by the petitioners were less than the marks by the persons who have been appointed as Primary School Teachers. The controversy with regard to the marks obtained by the petitioners and persons who have been appointed, being factual in nature could not be resolved by this Court in exercise of its constitutional jurisdiction. Consequently, the instant petition being misconceived and hit by laches is dismissed accordingly.
