Appellant and his counsel are called absent, no intimation is received. On the last date of hearing, counsel for the appellant was directed to satisfy the Court with regard to maintainability of instant appeal, which appears to have been filed after period of limitation and the counsel for the appellant was put on notice to submit explanation, but the counsel has not filed any explanation. It appears that the appellant having no explanation which appears to have been submitted, however, the appellant and his counsel were not vigilant to pursue the matter. Accordingly, instant matter is dismissed for non-prosecution alongwith listed applications.
