Learned counsel for the respondents No.2 to 5 seeks urgency in the matter on the ground that under instructions and to avoid further delay instant High Court Appeal may be allowed with the directions to the appellant to proceed in the suit, which was fixed for final arguments, whereas, further directions may be issued to the learned Single Judge to decide the case at an early date, preferably, within a period of two months from the date of this order.

Learned counsel for the appellant does not oppose the aforesaid terms, however, submits that another suit filed by the appellant i.e. Suit No.1952/2010 is also pending in respect of the subject property, which is fixed for evidence, therefore, requests that the appellant may be allowed to make a request before the learned Single Judge to pass appropriate order in that suit in accordance with law.

Be that as it may, since the learned counsel for respondents No.2 to 5 has given his consent for allowing this appeal in the aforesaid terms. Accordingly, instant High Court Appeal stands allowed with the directions to the counsel for the appellant to proceed in the aforesaid suit with arguments, whereas, it is expected that the same may be decided, preferably, within a period of two months in accordance with law.
