Appellant and his counsel are called absent, no intimation is received. Record reveals that after having filed instant appeal on 13.10.2018 against the impugned orders dated 11.09.2018 and 14.09.2018 passed by the learned Single Judge, on the original side, of this Court in Suit No.935/2018, whereby, CMA No.6530/2018 filed under Order XXXIX Rules 1&2 CPC was dismissed. Appellant and his counsel have not remained vigilant to proceed with the matter, which is pending since 2018 without any useful progress. It appears that appellant has lost interest in pursuing instant High Court Appeal, which is accordingly dismissed on account of non-prosecution.
