Appellant is called absent, no intimation is received. On the last date of hearing also, appellant was not in attendance. On 14.04.2021, when instant matter was taken up, appellant was directed to place on record all the cheques, which according to him, were issued by the respondent, on presentation were bounced and to assist the Court, as to whether he has obtained decree in respect of any of the cheques from any Court of competent jurisdiction. However, it appears that compliance of Court’s order has not been made. Impugned order also reflects that the appellant has filed three suits in respect of the same subject cheques, which were either returned to the appellant or dismissed for non-prosecution. Prima facie, there seems no error in the impugned order, which may require any interference by this Court in this appeal.

However, since the appellant has chosen to remain absent without any intimation despite issuance of intimation notice. Accordingly, instant appeal is dismissed on account of non-prosecution alongwith listed applications.
