            After arguing the matter at some length, learned counsel for the appellant submits that appellant will be satisfied and will not press instant High Court Appeal; provided that respondent/SBCA may be directed to provide an opportunity of being heard to the appellant before taking any adverse action against the impugned construction raised by him and in case, there is any violation of the approved building plan, which can be regularized, the same regularization may be extended to the appellant in accordance with law.

Accordingly, instant High Court Appeal stands disposed of in the above terms.
