            Learned counsel for the appellant submits that during pendency of instant High Court Appeal, the order passed by the learned Single Judge, on the original side, of this Court on the injunction application has been modified, whereas, contempt was alleged for non-compliance of the order, as referred to hereinabove, therefore, instant High Court Appeal has become infructuous. However, it has been submitted that the learned Single Judge may be directed not to draw any adverse inference pursuant to impugned order and to pass appropriate order on the contempt application, keeping in view hereinabove facts and circumstances of the case, at the time of hearing of main suit, and with these observations, instant High Court Appeal may be disposed of accordingly.

            Accordingly, keeping in view of the submissions of the learned counsel for appellant, instant High Court Appeal stands disposed of alongwith listed applications.
