Learned counsel for the respondent No.8 submits that there was an appeal which was dismissed as withdrawn for the reason that tender in dispute has scraped.

Be that as it may, since no one is coming forward to pursue instant High Court Appeal, which is pending since 2019 without any useful progress, therefore, the same is dismissed on account of non-prosecution alongwith listed application.
