No one is in attendance on behalf of the appellant, no intimation is received.

Instant appeal was filed on 14.12.2015 against impugned judgment dated 10.11.2015 and decree dated 12.11.2015 passed by the learned Banking Court No.III at Karachi in Suit No.155 of 2011 filed by the respondent Bank against the appellant for the recovery of Rs.17,983,898.82 under section 9 of the Financial Institutions (Recovery of Finances) Ordinance, 2001, whereby, the aforesaid suit was decreed in the sum of Rs.12,509,264/- with cost and cost of funds at the prevailing rate.

Record shows that after having filed instant appeal, learned counsel for the appellant did not proceed with the matter nor shown appearance and sought adjournments, whereas, notices in the instant appeal has not so far been issued to the respondents. Since instant appeal is pending since 2016 without any useful progress and nobody is coming forward to proceed with the matter. It appears that appellant has lost interest in pursuing instant appeal, which is accordingly dismissed on account of non-prosecution alongwith listed applications.
