                        The petitioners by way of instant constitutional petition have sought for direction against the respondents for their appointment in Police Department as Constables for the reason that they have qualified the      requisite test.

                        It is contended by learned counsel for the petitioners that the respondents are denying the legitimate right of the petitioners for their appointment in police service; therefore, they be directed to appoint the petitioners as Constables in Police Department.

                        Learned Addl.A.G Sindh by making reference to the comments filed by D.I.G, Larkana, has sought for dismissal of the instant constitutional petition by contending that one of the petitioner was found infected with Hepatitis “B” virus, while the other was having a criminal record.

                        We have considered the above arguments and perused the record.

                        The controversy with regard to the fact that one of the petitioner is found infected with Hepatitis “B” virus and the other is having a criminal record, disqualifying the petitioners from their appointment in police service, being factual in its nature, could not be resolved by this Court in exercise of its constitutional jurisdiction. Consequently, the instant constitutional petition being misconceived is dismissed accordingly.                                           JUDGE
