            Counsel for the appellant submits that this is an old matter, whereas, appellants, who are not traceable, are not coming forward to issue instruction, therefore, he does not want to press instant High Court Appeal.

No one is in attendance on behalf of the respondent No.1, whereas, Mr. Mohsin Khan, Advocate has shown appearance on behalf of the respondent No.2 and undertakes to file vakalatnama on the next date.

Since this is an old matter and is pending since 1975 without any useful progress, whereas, according to learned counsel for the appellant, appellants are not coming forward to pursue instant appeal, therefore, instant High Court Appeal stands dismissed on account of non-prosecution alongwith listed application.
