            No one is in attendance on behalf of the appellant, no intimation is received. On the previous dates of hearing also, no one was in attendance on behalf of the appellant and the matter was adjourned in the interest of justice, whereas, office was directed to issue direct notice to the appellant. It appears that direct notices have been issued to the appellant on his given address, however, no one is coming forward to pursue the instant High Court Appeal, which is pending since 21.08.1973 and was admitted to regular hearing vide order dated 05.11.2013, thereafter, it has been fixed for orders as to non-prosecution, however, appellant and his counsel are not coming forward to pursue instant High Court Appeal. It appears that appellant has lost his interest in pursuing instant appeal, which is accordingly, dismissed on account of non-prosecution alongwith listed application.
