6&7.     Counsel for the appellant submits that leave to defend application filed by the appellant was dismissed on account of being barred by limitation, whereas, the appellant had shown sufficient cause, however, the defence of the appellant has not been taken into consideration and the impugned judgment and decree have been passed without evidence of the appellant.

            Let pre-admission notice be issued to the respondents, to be served through first three modes, for a date to be fixed after four weeks, when reply/objection, if any, shall be filed with advance copy to the learned counsel for appellant. However, subject to limitation and objection by the respondents the appellant may deposit requisite Court-fees.
