ORDER

Agha Faisal, J.         The petitioner seeks directions to the Sindh Public Service Commission to recommend the petitioner for his appointment as medical officer and for such appointment to be sanctified by the Government of Sindh. The respondents’ comments demonstrate that the petitioner could not succeed in the interview/ viva-voce, hence, his candidature could not be considered for appointment. No vested right has been demonstrated by the petitioner before this court and even otherwise delving into the factual controversy of the petitioner's eligibility or lack thereof is not amenable to the writ jurisdiction of this court. It is, thus, our deliberated view that the petitioner has failed to set forth a case for exercise of the discretionary[1] writ jurisdiction of this Court. In view hereof, we are constrained to observe that the petition is misconceived, hence, is hereby dismissed.
