No one is in attendance on behalf of the appellant, no intimation is received. On the last date of hearing also, no one was in attendance on behalf of the appellant and the following order was passed: -

“Instant High Court Appeal was filed against the judgment dated 29.04.1981 passed in Suit No.277 of 1979, whereas, it was admitted to regular hearing vide order dated 24.09.1981, however, since then matter is being fixed for orders as to non-prosecution as the paper book is not prepared and cost is not paid. Nobody is coming forward to pursue the instant matter.

However, in the interest of justice, we would grant two weeks’ further time to comply with the office objection failing which instant High Court Appeal will be dismissed for non-prosecution. Let intimation notice be issued to the counsel for the appellant for the next date.

To come up after two weeks.”

As it has already been observed that instant appeal was filed on 25.11.1981, whereafter, appellant and its counsel have not remained vigilant to proceed with the matter. It appears that appellant has lost interest in pursuing the instant matter, which is accordingly dismissed on account of non-prosecution alongwith listed application.
