Appellant and his counsel are called absent, no intimation is received. On the previous two dates of hearing also, no one was in attendance on behalf of the appellant and the matter was adjourned in the interest of justice, whereas, on the first date of hearing, learned counsel for the appellant was directed to satisfy this Court as to maintainability of instant appeal, which appears to have been filed without fulfillment of the requirement under Order XXI Rule 23-A CPC. However, today neither the appellant or his counsel is in attendance, nor any satisfactory response has been submitted. It appears that the appellant has lost his interest in pursuing instant appeal, which is accordingly dismissed on account of non-prosecution alongwith listed application.
