IRSHAD ALI SHAH, J;- The appellant for being in possession of 200 grams of Charas, was convicted for offence punishable under section 9(b) of CNS Act 1997 and sentenced to undergo R.I for six months and to pay fine of rupees five thousand and in default whereof to undergo S.I for one month, with benefit of Section 382-B Cr.PC, by learned Sessions/Special Judge for CNS, Qamber-Shahdadkot @ Qamber, vide judgment dated 27.10.2021, which is impugned by the appellant before this Court by preferring the instant criminal appeal from jail.

2.        None has come forward to argue the instant criminal jail appeal on behalf of the appellant. However, learned Addl.P.G for the State by supporting the impugned judgment has sought for dismissal of the instant criminal jail appeal.

3.        We have considered the above arguments and have perused the record.

4.        The appellant was found to be in possession of 200 grams of Charas, and such allegation the prosecution has been able to prove by examining complainant ASI Sikandar Ali and his witnesses; their evidence finds support from positive report of chemical examiner. In these circumstances, the appellant was rightly convicted and sentenced by learned trial Court for the above said offence, by way of impugned judgment, which is not calling for any interference by this Court by way of instant criminal jail appeal, it is dismissed accordingly.
