                       It is contended by the petitioner that his father being employee of TMA, Sita, has died somewhere in year 2006; neither he is appointed under deceased quota, nor his pension is being released by the respondents. By contending so, he sought for direction against the respondents to appoint him under son quota and release pension of his late father.

                       On being asked, it is stated by the petitioner that his mother is alive. If she is alive, then she subject to entitlement alone can claim pension of her late husband. The petitioner has made claim for his appointment under deceased quota with lapse of 16 years. No justification is advanced by him to ignore such long delay. Consequently, the instant constitutional petition being hit by laches and second in its series (earlier being C.P.No.D-804/2012) is dismissed in limine with cost of Rs.1000/-, payable by the petitioner within one week.
