ORDER

 

Agha Faisal, J.         As noted in the order sheet dated 24.01.2022, a suit was decreed by the learned Senior Civil Judge, Larkana vide judgment dated 25.11.2015. An appeal was filed there against which was dismissed for non-prosecution by the 2nd Additional District Judge, Larkana, vide order dated 29.5.2018. The restoration application in such regard was also dismissed two years later on account of non-prosecution. Learned counsel was put on notice as to how under the present circumstances a revision was merited and his sole contention was that dismissal for non-prosecution was on account of dereliction of duty by the then counsel. No action was ever initiated by the applicant with respect to the said counsel. Be that as it may, there is no cavil articulated to the rationale employed by the respective courts in the successive dismissal of proceedings for non-prosecution and the samewas also confirmed by the learned counsel before this Court. No infirmity has been identified with respect to the successive orders and no case has been made out to entertain this revision under Section 115 CPC, therefore, the present proceedings are dismissed in limine.
