                        It is contended by learned counsel for the petitioners that the petitioners have qualified the requisite test, therefore, the respondents be directed to appoint them as Sub Inspector, Anti Encroachment Force in Board of Revenue, Government of Sindh.

                        Learned Addl.A.G Sindh while making reference to comments filed by Senior Member, Board of Revenue, Sindh, has sought for dismissal of the instant constitutional petition by contending that the petitioners have failed to qualify the requisite test for their appointment.

                        We have considered the above arguments and perused the record.

                        The petitioners have qualified or failed to qualify the requisite test for their appointment as Sub Inspector, Anti Encroachment Force in Board of Revenue, Government of Sindh, is involving factual controversy; same could not be resolved by this Court in exercise of its constitutional jurisdiction. Consequently, the instant constitutional petition being misconceived is dismissed accordingly.
