Heard arguments.
The applicant after due trial was convicted under section 23 of Sindh Arms Act, 2013 and was sentenced to undergo R.I for three years with fine of rupees ten thousand and in default whereof to undergo simple imprisonment for six months, by learned Assistant Sessions Judge, K.N.Shah, vide judgment dated 28.09.2021, which was impugned by the applicant by preferring an appeal, it was dismissed by learned 1st Additional Sessions Judge/MCTC, Dadu, vide judgment dated 09.12.2021, which is impugned by the applicant before this Court by preferring the instant criminal revision application, and in the meanwhile, the applicant has sought for suspension of his sentence and his release on bail, mainly for the reason that the sentence awarded to him is short one and hearing of his revision application is likely to take time, which is not opposed by Addl.P.G for the State.
In view of above, while relying upon case of Abdul Hameed Vs. Muhammad Abdullah and others (1999 SCMR-2589), the sentence awarded to the applicant is suspended, consequently, he is admitted to bail subject to his furnishing surety in sum of Rs.50,000/- and P.R bond in the like amount to the satisfaction of Additional Registrar of this Court.
The listed application (M.A.No.9025/2021) is disposed of accordingly.
