Mr. Safdar Ali Ghouri, Advocate for the applicant.

                                                =  *  = * = * = * = * =

The applicant by way of instant criminal revision application has impugned order dated 23.04.2021, passed by learned 4th Additional Sessions Judge, Larkana, whereby his direct complaint for prosecution of the private respondents for having committed offence punishable under section 3/4 of Illegal Dispossession Act, 2005, was dismissed.

It is contended by learned counsel for the applicant that the learned trial Court has recorded dismissal of the direct complaint of the applicant by way of impugned order without lawful justification; therefore, such order needs to be examined by this Court in exercise of its revisional jurisdiction.

I have considered the above arguments and perused the record.

As per impugned order, the parties are appearing to be disputed with regard to purchase/sale of the land and it is also reported by SHO concerned that nobody has encroached upon the barren/infertile land of the applicant. In these premises, learned trial Court was right to record dismissal of direct complaint of the applicant by making observation that the dispute between the parties is of civil nature, by way of impugned order, which is not found illegal to be interfered with by this Court by way of instant criminal revision application, which even otherwise is hit by laches and is dismissed in limine together with listed application.                                                      JUDGE
