4.                    The petitioner by way of instant constitutional petition has sought for restraint against the private respondents from raising construction over the encroached property, with restoration of its possession and registration of FIR against them for making such encroachment. The issue of encroachment over public property and restoration of its possession with registration of FIR for such encroachment, involving factual controversy, could not be resolved by this Court in exercise of its constitutional jurisdiction. Consequently, the instant constitutional petition being misconceived is dismissed in limine.
