Agha Faisal, J. (1) Deferred. (2) Granted; subject to all just exceptions (3)The petitioner inter alia seeks partition of purportedly inheritable land and possession thereof. Upon being confronted with the maintainability hereof, learned counsel submits that the petitioner would be satisfied and not press this petition if directions may be given to the Assistant Commissioner Ratodero to decide the petitioner’s application, in such regard, at the earliest. Bare perusal of the relevant application shows that the prayer therein seeks agitation of issues of alleged impersonation and also seek action against other legal heirs upon complaints of harassment etc. Learned counsel was asked to address the Court as to how such extraneous relief could be sought from the Assistant Commissioner and he remained unable to assist the Court in such regard. Notwithstanding foregoing, it is apparent that the prayer clause of this petition seeks relief not contemplated within Article 199 of the Constitution of Islamic Republic of Pakistan, 1973. In view hereof, the present petition and pending applications are hereby dismissed in limine.
