                        It is contended by learned counsel for the petitioner that the petitioner has qualified the requisite test for her appointment as Learning Coordinator (LCO) in Education Department, yet she is not being appointed by the respondents without lawful justification, therefore, they be directed to appoint the petitioner accordingly.

                        Learned Addl.A.G Sindh while making reference to the comments filed by District Education Officer (Primary) Larkana, has sought for dismissal of the instant constitutional petition by contending that name of the petitioner did not find place in merit list to make her entitled for the appointment.

                        We have considered the above arguments and perused the record.

                        The controversy that the petitioner having qualified the requisite test for her appointment as Learning Coordinator (LCO) in Education Department otherwise being factual in nature could not be resolved by this Court in exercise of its constitutional jurisdiction; therefore, the instant constitutional petition being misconceived is dismissed accordingly.
