2 to 5.             The dispute of ownership with regard to subject land with Evacuee Trust Property Board is advanced by the petitioner. When asked, how such dispute involving factual controversy could be resolved by this Court in exercise of its constitutional jurisdiction? Learned counsel for the petitioner was fair enough to state that he would not press the disposal of instant constitutional petition before this Court, if the petitioner subject to law is permitted to seek redressal of his grievance by filing a civil suit before the Civil Court having jurisdiction. Order accordingly.
