                        It is contended by learned counsel for the applicant that the applicant is apprehending danger to his life while attending the trial Court at Kandhkot, at the hands of the accused nominated by him for murder of his daughter Mst.Soomri; therefore, his case be transferred to any other Court of competent jurisdiction out of District Kashmore @ Kandhkot, which is opposed by learned Addl.P.G for the State and learned counsel for the private respondents.

                        As per comments furnished by learned trial Court, co-accused Mehrab has already been acquitted and the case against the private respondents now is proceeding. In that situation, seeking transfer of his case by the applicant outside district Kashmore @ Kandhkot under the pretext of apprehending danger to his life at the hands of accused is appearing to be false and attempt on his part to defeat early disposal of his case against the private respondents, which could not be permitted.

                        In view of above, the instant criminal transfer application fails and is dismissed accordingly.
