The petitioner by way of instant constitutional petition has sought for quashment of FIR Crime No.63/2021, u/s.353,506/2,503,147,148,149 PPC of P.S Radhan, for the reason that it has been lodged by the private respondent against him malafidely. As per report furnished by SHO, P.S Radhan, the charge sheet in above said FIR has already been submitted before the Court having jurisdiction. The cognizance of the case as per learned A.A.G and learned counsel for the private respondent has already been taken up by the Court having jurisdiction. After submission of the charge sheet and its cognizance by the Court having jurisdiction, the FIR could not be quashed by this Court legally. The petitioner, however, may join the trial and seek his premature acquittal in accordance with law by making such application before learned trial Court. Consequently, the instant constitutional petition is dismissed.
