1. Granted, subject to all just exceptions
2. It is, inter-alia, contended that the
applicant though was neither party in the instant petition but in terms of
order dated 04.06.2018 passed by this Court, the applicant allegedly shown as
absconder in four FIRs i.e. Crime Nos.08/2018 of Police Station Sobhodero u/s
302, 148, 149 and 337-H(ii) PPC, 43/2015 of Police Station Agra, u/s 302,
120-B, 148 and 149 PPC, 15/2017 of Police Station, Sobhodero u/s 324, 435, 148,
149, 427, 337-H(2) PPC and 14/2018 of Police Station Sobhodero u/s 324, 353 and
34 PPC. It is further contended that the applicant has been granted interim
pre-arrest bail in all the aforementioned crimes by the Court(s) of learned 1st.
Additional Sessions Judge/MCTC, Khairpur and 4th. Additional
Sessions Judge, Khairpur, respectively. He lastly prayed that since the
applicant has been granted pre-arrest bail in the aforesaid crimes, therefore,
he is no more absconder, hence the order passed by this Court for blocking his
CNIC is liable to be recalled. In this regard, he has placed on record
certified true copies of the order(s) passed by the trial Court(s).
Learned AAG Sindh raised no objection
for recalling the order dated 04.06.2018.
It appears from the record that
applicant Rafique Ahmed S/o Bosho Khan Pitafi was absconder in four FIRs i.e.
Crime Nos.08/2018 of Police Station Sobhodero u/s 302, 148, 149 and 337-H(ii)
PPC, 43/2015 of Police Station Agra, u/s 302, 120-B, 148 and 149 PPC, 15/2017
of Police Station, Sobhodero u/s 324, 435, 148, 149, 427, 337-H(2) PPC and
14/2018 of Police Station Sobhodero u/s 324, 353 and 34 PPC and in terms of
order dated 04.06.2018 his CNIC was blocked by the NADRA authorities. The applicant has surrendered himself before the
concerned trial Court(s) in the aforementioned crimes and has been admitted to
pre‑arrest bail, therefore, he is no more absconder. Learned counsel has
placed on record certified true copies of the pre-arrest bail grant orders in
favour of the applicant. Since the applicant is no more absconder in the
aforesaid crimes, accordingly, the order dated 04.06.2018 to the extent of
blocking the CNIC of the present applicant Rafique Ahmed Pitafi is recalled.
The
listed application stands disposed of in the above terms.
