Through the instant Constitutional Petition, petitioner / complainant seeks arrest of the absconding in Crime No.76/2019 registered at P.S Airport Sukkur for offences under Sections 302, 148, 149, 114, PPC. Presently, it is stated that challan has been submitted and the case is pending before competent Court of law.

Mr. Zulfiqar Ali Jatoi, Additional Prosecutor General, present in the Court in other cases, waives notice.

Learned counsel for the petitioner mainly argued that one accused has been arrested and remaining accused are absconding. Additional P.G submits that trial Court has plenty of the powers to issue the NBWs against the absconding accused, and the petition is not maintainable.

It is the matter of record that after usual investigation, challan has been submitted and the case is pending before competent Court of law. It is for the trial Court to proceed against the absconding accused in accordance with law.

The petition is without merit and the same is dismissed along with the listed applications.
