Pursuant to Court’s directions, learned counsel for the respondent/Customs Department files two statements on behalf of respondent/MCC (Port Muhammad Bin Qasim), Karachi in C.P. Nos.D-5337/2014 and 5115/2014, according to which, the amount of Rs.18,971,000/- received on behalf of M/s. Zam Zam Flour Mills and others in CP No.D-5337/2014 has been returned to the Nazir through cheque No.B980045, dated 01.12.2020, whereas, in the case of M/s. Q&Q Food Industries (Pvt) Limited in CP No.D-5115/2014, a cheque bearing No.B980047, dated 01.12.2020 in the sum of Rs.15,52,000/- has also been returned to the Nazir.

Nazir has furnished his report dated 15.12.2020 alongwith annexures and has stated that the aforesaid cheques have been received from the Customs Department.

Learned counsel for the petitioners in the aforesaid petitions request that Nazir may be directed to return the respective amount to the petitioners alongwith profit accrued thereon as mentioned in the Nazir report dated 21.08.2020.

Accordingly, Nazir is directed to issue cheque(s) in favour of the petitioners in the aforesaid petitions as per their respective shares proportionately alongwith profit accrued thereon after proper verification, identification and as per rules.

The listed applications stand disposed of in the aforesaid terms.
