2. Through this application filed under section 151 CPC learned counsel for the petitioner has prayed that due to inadvertence, instant case of petitioner, which was ordered to be de-tagged alongwith other petitions including C.P. No.D-8551/2017 relating to challenge the vires of section 4B of the Income Tax Ordinance, 2001 vide order dated 25.11.2019, could not be de-tagged and has been disposed of alongwith aforesaid petition on the point of vires of section 4B, hence requests that instant petition may be separated from the aforesaid bunch of cases including C.P. No.D-8551/2017 and may be fixed alongwith similar petitions pending before this Court including C.P. No.D-4570/2017 relating to double taxation treaty.

Contention of the learned counsel appears to be correct. Accordingly, this application (CMA No.22398/2020) is granted. The case of the petitioner i.e. C.P. No.D-655/2018 may be separated from the aforesaid bunch of cases including C.P. No.D-8551/2017 and be treated as pending and fixed alongwith aforesaid petition i.e. C.P. No.D-4570/2017 as per roster in accordance with law.
