3.         The applicant/surety by way of listed application has sought for return of surety papers for the reason that those are no more required by this Court.

            The perusal of record reveals that accused Abdul Razzaque alias Raza Muhammad was admitted to protective bail by this Court for seven days, on his furnishing surety in sum of rupees One Lac and P.R bond in the like amount to the satisfaction of Additional Registrar of this Court with condition that if he fails to appear before the learned trial Court within stipulated period, then amount of surety bond would be forfeited without further notice, vide order dated 05.10.2012.

            Accused Abdul Razzaque alias Raza Muhammad, as per learned counsel for the applicant/surety has failed to appear before the learned trial Court, as was directed by this Court. His failure to appear before learned trial Court in terms of order of this Court has rendered the forfeiture of his bail bond. In that situation, the surety papers could not be ordered to be returned to the applicant/surety.

            Therefore, the amount under bail bond shall be recovered from the applicant/surety, as arrears of land revenue, and then to be deposited in the relevant head/account of the State. 

            The listed application is disposed of accordingly
