04.                   The applicant by way of instant Criminal Transfer Application u/s 526 Cr.P.C has sought for transfer of his case from the Court of learned 1st Civil Judge & J.M, Dokri, to any other Court of competent jurisdiction at Larkana for the reason that he being resident of Larkana is not being allowed by the private respondents to attend the Court at Dokri.

                        On perusal of the FIR, the complainant himself is appearing to be resident of Dokri. When was confronted with such position, it was stated by learned counsel for the applicant that the applicant now has shifted to Larkana. On being asked, learned counsel for the applicant was not able to disclose the City Survey number of the house where the applicant presently is residing at Larkana. Obviously the applicant is intending to burden the private respondents in undue travelling expenses by getting his case transferred from Dokri to Larkana on false pretext of his having shifted to Larkana. No criminal case could be transferred from one Court to other on false and flimsy ground.

                        Consequently, the instant Criminal Transfer Application is dismissed in limine.
