            Learned counsel for the petitioner, while confronted as to maintainability of instant petition at this stage, when the appeal has been filed against the order of adjudication by the department, which is pending before the Customs Appellate Tribunal, has candidly submitted that since the Bench of the Customs Appellate Tribunal was not functional, therefore, petitioner filed instant petition for release of consignment, however, petitioner would not press instant petition and will pursue the remedy before the Customs Appellate Tribunal in accordance with law.

Accordingly, instant petition stands dismissed as not pressed.
