            Learned counsel for the respondent, under instructions, submits that against order-in-original in the instant case, an appeal has been filed before the Collector of Customs (Appeals), which is pending disposal.

In view of such statement, learned counsel for the petitioner submits that petitioner will be satisfied and will not press instant petition, provided that respondents may be directed not to encash the pay-order/bank guarantee furnished by the petitioner for the provisional release of subject consignment before the Collector of Customs (Appeals) till final disposal of appeal, whereas, 15 days further time may also be granted to the petitioner in case of any adverse order passed by the Collector of Customs (Appeals) to seek further remedy in accordance with law.

Learned counsel for the respondent as well as learned Asst. Attorney General do not oppose disposal of instant petition in above terms.

Accordingly, instant petition stands disposed of in above terms alongwith listed application.
