Pursuant to Court’s Notice, Ms. Masooda Siraj, Advocate has shown appearance, files vakalatnama on behalf of the respondent No.2 alongwith comments, which are taken on record, copy of which has been supplied to the learned counsel for petitioner.

Learned counsel for the petitioner, under instructions, submits that consignment of the petitioner has been provisionally released, therefore, the petitioner will be satisfied and will not press instant petition; provided that the respondents may be directed to assess the consignment of the petitioner in accordance with law after providing an opportunity of being heard to the petitioner and in case of any dispute provision of section 25 of the Customs Act, 1969 may be invoked in terms of the decision of this Court as well as of the Hon’ble Supreme Court on the subject controversy.

Learned counsel for the respondent No.2 as well as learned Asst. Attorney General do not oppose disposal of instant petition.

Accordingly, instant petition stands disposed of in above terms alongwith listed application.
