Learned counsel for the petitioner, under instructions, submits that consignment of the petitioner has been released provisionally under section 81 of the Customs Act, 1969, subject to securing duties and taxes before the concerned Collectorate, therefore, the petitioner is satisfied and will not press instant petition, provided that respondents may be directed to conduct themselves and make adjudication strictly in accordance with law after providing an opportunity of being heard to the petitioner.

Learned counsel for the respondents as well as learned Asst. Attorney General do not dispute such factual position and submit that instant petition may be disposed of accordingly.

Accordingly, instant petition stands disposed of in the above terms alongwith listed application. However, it is expected that adjudication process may be completed within a period of four weeks from the date of receipt of this order after providing an opportunity of being heard to the petitioner.
