                    At the very outset, it is stated by learned counsel for the applicant that while dismissing an application under section 22-A(6)(ii)Cr.PC, the learned Ex-Officio Justice of Peace has imposed cost of rupees ten thousand upon the applicant, payable to District Bar Association, Shikarpur, which is unjustified and unlawful. If it is waived then they would not press the disposal of instant Crl.Misc.Application before this Court on merit, provided that the applicant is permitted to exhaust his remedy under section 200 Cr.PC.

                   The proposal advanced by learned counsel for the applicant is not opposed by learned D.P.G for the State and learned counsel for the proposed accused.

                   In view of above, the order of learned trial Court to the extent of imposing cost of rupees ten thousand upon the applicant is set-aside, with permission to the applicant to exhaust his remedy u/s.200 Cr.PC.

                   The instant Crl.Misc.Application is disposed of accordingly.
