O R D E R
ADNAN-UL-KARIM MEMON, J. – Basically, by means of this petition, the
Petitioner is seeking direction to the Respondents to release his G.P fund, on the premise that he applied for non-refundable GP fund advance amount of Rs.1,61,600/-, however, the same was accorded by the competent authority vide Notification dated 17.2.2020 but nothing could be done by the respondent No.6. Petitioner being aggrieved by and dissatisfied with the aforesaid action of the respondent No.6 has approached this Court.
2. Mr. Achar Khan Gabol learned Counsel for the petitioner briefed us on the factual background of the case and submitted that the Respondent Secretary has already issued such Notification for non-refundable GP fund advance amount of Rs.1,61,600/ in favor of the Petitioner; therefore, he is entitled for the relief claimed in the instant petition being an employee of the Education and Literacy Department, Government of Sindh.
3. Today
District Accounts Officer Ghotki @ Mirpur Mathello has appeared and filed
statement to the effect that the petitioner submitted his 100% Non-Refundable
GP Fund Case at the counter of this office; that his office requires original Service
Book of the Petitioner along with all relevant
documents.
4. Prima-facie,
the claim of the Petitioner is admitted by the Respondent-Department on the
analogy that if Petitioner approaches his office his grievances will be
redressed accordingly.
5. We in the
circumstances are constrained to direct the respondent No.6 to pay all his legal
dues to which he is/was entitled to on issuance of Notification dated 17.2.2020
within one week and report compliance through Additional Registrar of this Court.
6. The instant
Petition stands disposed of in the above terms.
